Metaverso è un termine utilizzato per descrivere uno spazio virtuale collettivo condiviso, creato dalla convergenza di una realtà virtuale immersiva e di una realtà fisica migliorata virtualmente. Le prospettive di applicazione e di sviluppo di tale realtà sono enormi e in massima parte, ad oggi, non prevedibili. Ciononostante è possibile e necessario interrogarsi, con le categorie filosofiche e giuridiche attuali, sulla natura e il significato di questo spazio, sulle relazioni tra i soggetti che ne fanno parte o che lo controllano e, infine, su alcune fondamentali implicazioni per la tutela dei dati personali.

It is known that new technologies affect not only private life, but also have a vast influence on people’s status and orientations and, thus, on their constitutional freedoms. Talking about the metaverse means taking a step even forward: functions and structure of this digital “mundus novus” are still unclear. Nevertheless, the present article aims to investigate the potential legal issues in the metaverse, with a focus on the ones of public nature: from the redesigned relations between the actors (Nation-states, platforms and citizen-users) to the alteration/adaptation of the users’ rights and freedoms.
